Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in federal detention.

In her order, the judge pointed out that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court challenge center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The judge, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
